1. Introduction

These Terms & Conditions ("Terms") govern your use of Clouderized ("the Platform"), a Container as a Service hosting platform operated by the Clouderized team. By registering an account or using the Platform, you agree to be bound by these Terms.


2. Eligibility & Account Registration

2.1 Age Requirement

You must be at least 18 years old and legally capable of entering into binding agreements to use the Platform.

2.2 Account Responsibility

You are responsible for providing accurate, complete information during registration. You agree to keep your account credentials secure and are liable for all activity on your account.

2.3 Multiple Accounts

You may not register multiple accounts to circumvent usage limits or trial restrictions.


3. Acceptable Use

You agree not to use the Platform to:

  • Deploy or distribute malware, viruses, ransomware, or any malicious code
  • Engage in spam, phishing, or unauthorized access attempts
  • Host or transmit illegal content, including stolen data or copyrighted material without authorization
  • Conduct cryptocurrency mining or proof-of-work operations
  • Launch attacks (DoS, DDoS, brute-force) against any system
  • Violate any applicable law or regulation
  • Reverse-engineer, bypass, or disable Platform security controls

Violation of this section may result in immediate account suspension or termination.


4. Infrastructure Limitations

4.1 Email (SMTP) Restriction

The Platform blocks outbound SMTP traffic on ports 25, 465, and 587 at the infrastructure level. This is a platform limitation, not a violation basis. For transactional emails (notifications, confirmations, etc.), you must use third-party email APIs (e.g., Sendgrid, Mailgun, AWS SES).

4.2 Resource Limits

Your containers are allocated memory and CPU according to your subscription tier:

  • Starter: 512 MB RAM, 0.5 vCPU
  • Pro: 2 GB RAM, 2 vCPU

The Platform may throttle or stop containers that exceed these limits to protect shared infrastructure.

4.3 Outbound Egress

Egress traffic is monitored. New deployments are subject to rate limiting (100 connections/minute for the first 24 hours) to detect abuse.


5. Content Responsibility

5.1 Your Responsibility

You are solely responsible for:

  • The code, data, and content deployed to your containers
  • Ensuring your containers comply with applicable laws
  • Securing your application and managing secrets (API keys, database credentials)
  • Monitoring and debugging your deployed services

5.2 Operator's Limited Liability

The Operator does not monitor, moderate, or filter container traffic or output. You acknowledge that the Operator is not liable for content hosted on your containers.


6. Service Availability & Support

6.1 Uptime

The Platform targets approximately 99% uptime for Phase 1 (MVP). This is a target, not a guaranteed Service Level Agreement (SLA). The Platform is provided on an "as-is" basis.

6.2 Maintenance

The Operator may perform maintenance that briefly interrupts service. Maintenance windows will be communicated where practicable.

6.3 No Support SLA

Community support is provided on a best-effort basis. Response times are not guaranteed. Critical security issues will be prioritized.


7. Data & Infrastructure Location

All customer data and containers are hosted on a single Virtual Private Server (VPS) located in Singapore (Contabo). You acknowledge this single-region deployment and accept the associated risks.


8. Operator Access

The Operator may access your container environment to:

  • Provide customer support
  • Investigate abuse or security incidents
  • Perform system maintenance or debugging

Access will include notice where operationally feasible. You acknowledge that the Operator may view logs, environment variables, and running processes during such access.


9. Billing & Payments

9.1 Pricing

Subscription plans are billed monthly in Singapore Dollars (SGD). Prices are subject to change with 30 days notice.

9.2 Auto-Renewal

Your subscription automatically renews each month on the anniversary of your billing date. Cancellation takes effect at the end of the current billing period.

9.3 Trial Period

A 7-day free trial is available with a S$1 refundable identity verification charge. Failure to cancel before the trial ends will convert to a paid subscription.

9.4 No Refunds

Subscription fees are non-refundable except for:

  • Unused trial periods (7-day trial, within the trial window)
  • Verified billing errors, refunded within 30 days of dispute

Monthly subscriptions are billed in advance and cannot be prorated for cancellations within the month.

9.5 Payment Processor

Payments are processed by Stripe. Your payment information is not stored by Clouderized; see the Privacy Policy for details.


10. Account Suspension & Termination

10.1 Suspension

The Operator may suspend your account immediately if:

  • You violate the Acceptable Use Policy (Section 3)
  • Your account is used for abuse (egress abuse, spam, brute-force attacks, etc.)
  • You fail to pay invoices after 30 days of notice
  • You represent a security risk to the Platform or other customers

10.2 Termination

The Operator may terminate your account with 30 days written notice for any reason or no reason. Termination for cause (violation of these Terms) may be immediate.

10.3 Data Retention

Upon account termination, your containers are stopped. Customer data (container files, databases) is deleted within 30 days unless legally required to retain.


11. Intellectual Property

11.1 Your Ownership

You retain all ownership and intellectual property rights to your code and data deployed on the Platform.

11.2 Operator License

You grant the Operator a non-exclusive license to use, copy, and display your code and data only to the extent necessary to provide the Platform services (e.g., running your containers, monitoring health, storing backups).


12. Disclaimers & Limitation of Liability

12.1 As-Is Service

The Platform is provided "as-is" without warranties, express or implied. The Operator makes no guarantees regarding uptime, performance, or fitness for any particular purpose.

12.2 Limitation of Damages

To the fullest extent permitted by law, the Operator's total liability for any claim is limited to the amount you paid for the Platform in the 3 months preceding the claim. In no event shall the Operator be liable for:

  • Lost profits, revenue, or data
  • Business interruption
  • Indirect, incidental, special, or consequential damages
  • Damage to your reputation or business

13. Indemnification

You agree to indemnify and hold harmless the Operator from any claims, damages, or costs arising from:

  • Your use of the Platform in violation of these Terms
  • Your code or data causing harm to third parties
  • Your breach of applicable law
  • Disputes between you and your own customers

14. Changes to Terms

The Operator may update these Terms at any time. Material changes will be communicated via email (30 days notice). Your continued use of the Platform following such notice constitutes acceptance of the updated Terms.


15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to its conflict-of-law principles. Both parties irrevocably consent to the exclusive jurisdiction of the courts of Singapore.
